Red Cross Assists Hamas in Search for Bodies of Israeli Hostages in Gaza Strip

A Red Cross official stated that its personnel joined Hamas officials into zones of Gaza currently controlled by Israeli military control to facilitate the hunt for the bodies of Israeli hostages.

Ceasefire Agreements and Hostage Remains Handover

Under the US-brokered ceasefire, which began on October 10, Hamas is required to hand over the remains of all captives promptly. In exchange, Israel has agreed to transfer 15 Palestinian bodies for each Israeli.

The organization has so far returned the remains of fifteen of those taken hostage but zero in the last five days, as some of those remains are believed to be in areas past the yellow line marking the temporary truce line.

Red Cross Involvement as Neutral Intermediary

“At the request of the parties, the International Committee of the Red Cross (ICRC) joined a party to the conflict as the party searched for the remains of the deceased beyond the military-established ‘yellow line’,” stated a representative for the committee.

The spokesperson continued: “Those involved to the conflict determined the modalities of the operation and entrusted the ICRC to serve as a neutral intermediary. The ICRC was not involved in the discussions.”

The official further explained: “The ICRC was did not participate in the search for the bodies nor does it take part in the physical recovery of remains.”

Global Legal Standards and Duties

According to global legal norms, it is the duty of the sides engaged in a hostilities to search for, collect, and recover human remains.

US Ultimatum and Local Recovery Operations

On Saturday, the US president delivered a two-day demand to the organization. “Hamas is going to have to start returning the remains of the hostages who died, including American citizens, promptly, or the additional nations participating in this significant truce will intervene,” he wrote on his online channel.

When the two-day window approached, the group, joined by the ICRC, joined teams from Egypt, who were granted permission by Israel to look for remains past the line marking the withdrawal of troops inside Gaza. An Israeli spokesperson said the delegation would use heavy machinery and vehicles in the search.

Official Verification and Media Reports

This development was supported by an unnamed Israeli official, who told Hebrew-language media that Hamas representatives had been permitted to access sections of Gaza under military authority to look for the bodies of captives, together with Egypt’s and ICRC teams.

“To achieve this goal, Hamas members were permitted to cross the designated boundary,” the official was cited as saying.

Footage published by a media outlet appeared to show members of a specialized group – belonging to the group’s military wing tasked with holding captives – escorting a humanitarian transport in a specific location near Rafah, which lies outside IDF jurisdiction.

Challenges in Locating Captive Remains

Efforts to locate for the remains of Israeli hostages has become one of the most delicate issues in the ceasefire agreed between the parties. Yet, the effort to find the remains has proved difficult from the beginning, given the presence of an approximate 60m tonnes of rubble across the strip, where, according to health officials, at least 10,000 Palestinians are recorded as unaccounted for, trapped under the rubble.

Diverging Claims on Remains Whereabouts

The group has claimed it does not know the precise whereabouts of all the remains, saying it has lost contact with a number of its teams that had been holding the hostages and were allegedly killed during Israeli bombardments.

In contrast, an Israeli government spokesperson asserted that the organization knew the whereabouts of the bodies. “If Hamas made more of an effort, they would be able to retrieve the remains of our hostages,” the spokesperson said.

US Stance and Disarmament Discussions

While the US president has conceded that a portion of the bodies are difficult to access, he said that “others they can return immediately and, for unknown reasons, they are not.”

“It may have to do with the disarming of the group,” he noted.

Washington has said it has received guarantees from Hamas that the group will disarm, though no clear timeline has been set. They remains reluctant to give up its arms without solid assurances about the future of its members.
